The medical license of a doctor was
revoked based upon a hearing officer’s findings of fact that the doctor
had misused the doctor/patient relationship. The results of a patient’s
lie detector test were admitted into evidence before the hearing officer
over the doctor’s objection.
Ms. Lippincott represented the doctor on
appeal. The appellate court reversed the revocation of the doctor’s
license and remanded for a new trial because polygraph results are
inadmissible in administrative hearings just like in other Florida
proceedings.
