The
Plaintiffs sued the Defendants for negligence, filing their complaint
only two days before the expiration of the four year statute of
limitations. The action was dismissed by the Orange County Circuit Court
for the Plaintiff's failure to comply with RCP 1.070 (j) - serving a
Defendant within 120 days after the filing of the complaint.
Ms. Lippincott represented the Plaintiffs
on appeal and was successful in having their negligence action
reinstated.
