The
plaintiffs brought an action in the Eighteenth Judicial Circuit of
Seminole County, Florida concerning the ownership of stock in two
corporations. The plaintiffs sought to enforce a New York state court
judgment that a decedent owned the stock in these corporations at the
time of his death and thus this stock was a part of his estate. The
Defendants claimed that the decedent had gifted this stock to the
children of his first family at the time these corporations were
created, and that New York had no jurisdiction.
The trial
court entered summary judgment for the defendant corporations finding
that the plaintiff’s action was barred by a five-year statute of
limitations governing actions on a foreign judgment. Ms. Lippincott
represented the defendant corporations in this appeal, and the trial
court decision in favor of the defendants was upheld.
