McGhee v.

The
plaintiff claimed he was beaten and injured during an arrest by a deputy
sheriff. He sued the county for his injuries. The Volusia County Circuit
Court granted summary judgment for the county finding that the deputy’s
actions of beating an arrestee were outside the scope of his employment.
Ms.
Lippincott represented the plaintiff on appeal to the Florida Supreme
Court. The Supreme court reversed the Fifth District and directed the reinstatement of the plaintiff’s action. The
court found that the scope of employment issue required a trial on the factual questions
presented.
