United Pacific Ins. Co. v. Berryhill,

(Fla. 5th DCA 1993).
A car purchaser sued to
collect damages on a motor vehicle dealer bond issued by an insurance
company for a defunct auto dealer. The Marion County Circuit Court
granted summary judgment for the car purchaser and awarded treble
damages and attorney fees.
Ms. Lippincott represented
the insurance company on appeal. The appellate court reversed the award
of treble damages and the attorney fees award. The Fifth District Court
of Appeal held that the bond covered only actual losses and not fines or
penalties.
