The sellers
of a home were found responsible for breaching a contract and for fraud
in connection with the sale and the buyer’s discovery of termite damage.
The Volusia County Circuit Court entered judgment against the sellers
for $396,651.
Ms.
Lippincott represented the sellers on appeal. The appellate court
reversed the judgment and remanded for a new trial on damages, finding
that the evidence did not support the damage award, and that the issue
of whether a $115,000 payment to the buyer under a termite bond should
be set off from any damage award remained open.
